PERSONAL RİGHTS OF MİLİTARY JUDGES

The personal rights of military judges has been arranged by the Military Judges Law which came into force in 1963.

The sources from which military judges and prosecutors are employed in the Armed Forces:

a. Those who are sent to faculties of law out of the active officers.

b. Those who granduated from the faculties of law out of those who left military high schools and attended the war academies.

c. Those reserve offıcers who have been successful at units and finished faculties of law.

d. Those who finished faculties of law free of the army out of the war academi-graduated officers, in the first three years of their ranks of first lieutenant and captain

e. Women who finished the faculties of law free of the army.

The judges and Prosecutors employed out these seurces shaal perform their duties of judge and prosecutor asisstance for a period of three years after which those who have been succesful are transtered to the status of judge as a full judge.

The military prosecutors promote acording to the grades given by the Military Court of Appeals and to the records hold by their executive seriors.

And the military prosecutors and their assistants promote according to the remorks made by the Military Court of Appeals and reports of the Military Court of Appeals Inspectors and the records had by the executive seniors.

The military judges and prosecutors are given post assurance in respect of nomination. They can not be nominated to another post or task before 4 years without their will.

The military judges and prosecutors receive the same salary and judiciary fund with the civilian colleagues Military judges and prosecutors receive egual salaries for the duties they carry out within the executive staff and judiciary task.

Conducting an inquiry about the military judges and prosecutors is subjuct to permission of Ministry of National Defense. The inquiries are being conducted by MND Military Justice lnspectors. And the disciplinary penalties are imposed by Minister of National Defense.
